The Parliament of South Australia enacts as
follows:
This Act may be cited as the Subordinate Legislation (Disallowance)
Amendment Act 2020.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.
Part 2—Amendment
of Subordinate Legislation
Act 1978
After section 10 insert:
10AAA—Remaking disallowed
regulations
(1) A regulation (the
later regulation) that is the same in substance as another
regulation (the disallowed regulation) that has been disallowed by
a resolution of either House of Parliament may not be made within the period of
6 months after the day of disallowance.
(2) However, the later regulation may be made within that period if the
House of the Parliament that passed the resolution to disallow the disallowed
regulation approves, by resolution, the making of a regulation that is the same
in substance as the disallowed regulation.
(3) A regulation made in contravention of this section is of no
effect.
