The person applying for any such special grant shall, in addition to the oath
usually taken by administrators, make oath that the executor or administrator
of such deceased person is resident out of the State, and if the applicant is
not the Public Trustee, that he is thereby delayed in recovering or obtaining
payment of moneys or the possession of estate to which he is by law entitled.
