In an administration by the Supreme Court, or under section 9 of the
Public Trustee Act 1995 , by the Public Trustee, of the estate of a
person dying on or after the first day of February, 1892, and in the
administration of any such estate by the executor or administrator under
section 60, the following provisions shall have effect:
(a) the
executor or administrator shall have no right of retainer;
(b) a
creditor who has at any time obtained judgment against the executor or
administrator shall not, by reason of the judgment, have any priority over
other creditors;
(c)
legal assets shall, subject to this Act, be administered in the same manner as
equitable assets.
