ADVANCE CARE DIRECTIVES ACT 2013 - SECT 50

50—Failing to comply with direction of Tribunal

        (1)         Subject to this Act, a person who fails to comply with a direction of the Tribunal under section 48 is guilty of an offence.

Maximum penalty: $20 000 or imprisonment for 6 months.

        (2)         It is a defence to a charge of an offence against subsection (1) if the defendant proves that the defendant did not know, and could not reasonably have been expected to know, that their conduct amounted to a failure to comply with the relevant direction.
