55—False or misleading statements
(1) A person who
knowingly makes a false or misleading statement in, or in relation to, an
advance care directive is guilty of an offence.
Maximum penalty:
(a) if
the defendant is a substitute decision-maker appointed under the
advance care directive—$20 000 or imprisonment for 2 years;
(b) in
any other case—$10 000.
(2) A person who
knowingly makes a false or misleading statement in relation to an attempt to
give an advance care directive is guilty of an offence.
Maximum penalty: $10 000.
(3) For the purposes
of subsection (1), a reference to a substitute decision-maker includes a
reference to a person who is not but who was, at the relevant time, a
substitute decision-maker appointed under the advance care directive.
