124—Chief Executive to have regard to certain matters
In determining whether to transfer a child protection order to a participating
State under this Part, the Chief Executive must have regard to—
(a) any
sentencing order (other than a fine) in force in respect of the child, or
criminal proceeding pending against the child in a court, of which the
Chief Executive is aware; and
(b)
whether the Chief Executive or an interstate officer is in the better position
to exercise the powers and responsibilities under the order; and
(c) the
desirability of the order being an order under the child welfare law of the
State where the child resides.
