A person who—
(a)
sells a piece of equipment for use in connection with the smoking, consumption
or administration of a controlled drug, or the preparation of such a drug for
smoking, consumption or administration; or
(b) has
possession of a piece of equipment, intending to sell it for such use,
is guilty of an offence.
Maximum penalty:
(a) for
a basic offence—
(i)
if the offender is a serious drug
offender—$20 000 or imprisonment for 5 years, or both; or
(ii)
in any other case—$15 000 or imprisonment for 3
years, or both;
(b) for
an aggravated offence—$20 000 or imprisonment for 5 years, or both.
