27—Application for working with children check
(1) Subject to this
Act, an application for a working with children check—
(a) must
be made to the central assessment unit by the person to whom the
working with children check relates; and
(b) must
be made in a manner and form determined by the central assessment unit; and
(c) must
be accompanied by such information as may reasonably be required by the
central assessment unit; and
(d) must
be accompanied by the prescribed fee.
(2) The regulations
may make further provision in relation to applications for
working with children checks (including by allowing an application to be made
for or on behalf of a person by their employer or another person).
(3) The central
assessment unit may refuse to consider an application if—
(a) the
central assessment unit has conducted a working with children check in
relation to the person to whom the application relates within the preceding
5 years; and
(b) on
completion of that working with children check, the central assessment unit
issued a prohibition notice to the person; and
(c) that
prohibition notice has not been revoked.
(4) The central
assessment unit must, in accordance with any requirements set out in the
regulations—
(a)
issue a receipt in the prescribed form to each applicant for a working
with children check; and
(b) if
the person to whom the working with children check relates does not have a
unique identifier—issue a unique identifier to the person in accordance
with section 29.
