95D—Referral of matters to Tribunal
(1) If, following an
investigation of a matter referred to the Commissioner, the Commissioner is of
the opinion that the matter should be referred to the Tribunal for hearing and
determination, the Commissioner will lodge a complaint with the Tribunal in
respect of the matter.
(2) If, following an
investigation of a matter referred to the Commissioner, the Commissioner
determines that the matter should not be referred to the Tribunal, the
Commissioner must, by notice in writing to the person the subject of the
investigation, inform the person of that determination.
