131—Commencement of proceedings for summary offences
(1) Proceedings for a
summary offence against this Act may only be commenced by an
authorised officer.
(2) Proceedings for a
summary offence against this Act may be commenced at any time within three
years after the date of the alleged commission of the offence or, with the
authorisation of the Attorney-General, at any later time within 10 years after
the date of the alleged commission of the offence.
(3) An apparently
genuine document purporting to be signed by the Attorney-General authorising
the commencement of proceedings under this Act must be accepted in legal
proceedings, in the absence of proof to the contrary, as proof of the
authorisation.
(4) Where proceedings
for a summary offence against this Act are commenced by an authorised officer
who is an officer or employee of a council, any penalty imposed in respect of
the offence is payable to and may be retained by the council.
