FISHERIES MANAGEMENT ACT 2007 - SECT 78

78—Unauthorised activities relating to exotic organisms or noxious species prohibited

        (1)         A person must not, except as authorised by a permit issued by the Minister—

            (a)         bring, or cause to be brought, into the State; or

            (b)         take from any waters; or

            (c)         sell, purchase or deliver; or

            (d)         have possession or control of,

aquatic resources of a noxious species.

Maximum penalty:

            (a)         in the case of a body corporate—$250 000;

            (b)         in the case of a natural person—$120 000.

        (2)         A person must not, except as authorised by a permit issued by the Minister—

            (a)         release or permit to escape into any waters

                  (i)         exotic fish; or

                  (ii)         aquaculture fish; or

                  (iii)         fish that have been kept apart from their natural habitat; or

            (b)         deposit in any waters

                  (i)         fish of a kind referred to in paragraph (a); or

                  (ii)         exotic aquatic plants.

Maximum penalty:

            (a)         in the case of a body corporate—$250 000;

            (b)         in the case of a natural person—$120 000.

        (3)         The Minister must, before making a decision on an application for a permit that relates to, or is to apply in respect of, a specially protected area, consult with the relevant Minister.
