22B—Entitlement to compensation
(1) Subject to this
Act, a person who has an alienable interest in land is entitled to
compensation for the acquisition of the land under this Act if—
(a) the
person's interest in the land is divested or diminished by the acquisition; or
(b) the
enjoyment of the person's interest in the land is adversely affected by the
acquisition.
(2) However, the
requirement under subsection (1) that an interest be alienable does not
apply in relation to an interest consisting of native title.
