(1) A licence granted
under section 17 is subject to the following conditions:
(a) a
condition that the holder of the licence must comply with the requirements
prescribed by the regulations for the provision of information to labour hire
workers by persons who provide labour hire services;
(b) such
other conditions as the Commissioner thinks fit.
(2) The Commissioner
may, at any time after the grant of a licence, vary or revoke a condition of
the licence imposed under subsection (1)(b) or impose a further condition
on the licence as the Commissioner thinks fit.
(3) If the
Commissioner proposes to impose a further condition on a licence or vary a
condition of a licence under subsection (2), the Commissioner must give
the holder of the licence a notice stating—
(a) the
proposed condition or variation of a condition; and
(b) the
reasons for the proposed condition or variation; and
(c) that
the holder of the licence may, within 14 days after the notice is given, give
the Commissioner a written response to the proposed condition or variation.
(4) The Commissioner
must, before imposing a further condition on a licence or varying a condition
of a licence under subsection (2), take into account the response of the
holder of the licence to the notice under subsection (3) (if any).
(5) A person who fails
to comply with a condition of a licence under subsection (1)(a) is guilty
of an offence.
Maximum penalty: $4 000.
Expiation fee: $300.
