(1) No oil shall be
transferred between sunset and sunrise to or from a ship in State waters
without the written permission of—
(a) a
port manager; or
(b) the
Minister.
(2) Permission under
this section to transfer oil may be given—
(a) in
individual cases or generally to transfers that are carried out in specified
circumstances;
(b)
subject to such conditions or limitations as the port manager or Minister
thinks fit.
(4) If oil is
transferred to or from a ship in contravention of this section or a condition
or limitation imposed under this section, the owner and master of the ship
and, if the oil is transferred from or to a place on land, the person in
charge of that place, are each guilty of an offence.
Maximum penalty: $8 000.
