ROADS (OPENING AND CLOSING) ACT 1991 - SECT 34C

34C—Minister may order that road be opened or closed

        (1)         The Planning Minister may, on the basis of information set out in an Assessment Report under the Planning, Development and Infrastructure Act 2016 , in conjunction with giving a development authorisation under section 115 of the Planning, Development and Infrastructure Act 2016 in relation to the relevant development, by notice in the Gazette, make an order that a road be opened or closed.

        (2)         The Planning Minister may, in making an order under subsection (1)—

            (a)         —

                  (i)         fix a day on which the order will take effect; or

                  (ii)         provide that the order will take effect on a day to be fixed by subsequent order of the Planning Minister published in the Gazette; and

            (b)         make any other provision that the Planning Minister considers to be necessary or expedient for the purposes of this Act.

        (3)         The Planning Minister may, by subsequent notice in the Gazette, vary or revoke an order under subsection (1).

        (4)         The Surveyor-General must, as soon as practicable after an order to open or close a road is made under this section, cause survey plans and other documents to be prepared as required by the Registrar-General in order to facilitate the operation of the order under this Act.
