118—Liability of operator
(1) A person commits
an offence if—
(a)
there is a breach of a light vehicle standards or maintenance requirement; and
(b) the
person is the operator of the light vehicle concerned.
Maximum penalty: $2 500.
(2) It is a defence to
a charge for an offence against this section if the person charged establishes
that the vehicle was being used at the relevant time by—
(a)
another person not entitled (whether by express or implied authority or
otherwise) to use it, other than an employee or agent of the person; or
(b) by
an employee of the person who was acting at the relevant time outside the
scope of the employment; or
(c) by
an agent of the person who was acting at the relevant time outside the scope
of the agency.
