105C—Application to Tribunal if house rules are considered unreasonable
(1) An application may
be made to the Tribunal by a resident of a rooming house for a declaration
that a house rule for the rooming house is unreasonable.
(2) On an application
under this section, the Tribunal may, by order—
(a)
declare the rule or proposed rule to be reasonable; or
(b)
declare the rule or proposed rule to be unreasonable and, if the Tribunal
considers it appropriate, require the proprietor to amend the rule in a
specified manner.
(3) A house rule is
void if the Tribunal makes an order that the rule or proposed rule is
unreasonable.
(4) If a proprietor
does not amend a house rule as required by order of the Tribunal, the
proprietor is guilty of an offence.
Maximum penalty: $25 000.
Expiation fee: $2 000.
