111—Power of Minister to cancel unperformed hours of community service
(1) If, on the
application of a person required to perform community service under a bond or
an order of a court, the Minister for Correctional Services is satisfied
that—
(a)
although some hours of community service remain unperformed, the person has
substantially complied with the requirement; and
(b)
there is no apparent intention on the person's part to deliberately evade the
person's obligations under the bond or order; and
(c)
sufficient reason exists for not insisting on performance of some or all of
those hours,
the Minister may, by instrument in writing, waive compliance with the
requirement to perform those hours, or a specified number of them.
(2) The Minister
cannot exercise powers under subsection (1) to waive performance of more
than 10 hours under the 1 bond or order.
(3) The Minister must
notify the probative or sentencing court of any exercise of powers under
subsection (1).
