South Australian Current Acts South Australian Current Acts121—Liability of Treasurer for default of registrar
(1) The Treasurer
shall be liable to make good to the suitors of the court all suitors' funds
and securities in court, and for that purpose may by authority of this Act,
and without any further appropriation, make any necessary payments out of the
general revenue of the State.
(2) If the Chief
Justice certifies to the Treasurer in writing that the registrar has failed to
pay any money in court or to transfer or deliver any securities in court
required by law or by any order of the court to be paid, transferred, or
delivered by him, or has been guilty of any default with respect to any such
money or securities, the Treasurer shall pay out of the general revenue to
such persons as are named by the Chief Justice in the certificate, such sums
as the Chief Justice certifies in writing to be required for the purpose of
paying the money so required to be paid or of replacing the securities so
required to be transferred or delivered, or of making good such default.
