41—Persons having lien at common law may sell
Every person who has bestowed work or materials upon any chattel or thing in
altering the condition thereof, or improving the same, and who is entitled to
a lien on such chattel or thing at common law, may, while such lien exists, if
the amount due to him in respect of such lien remains unpaid for one month
after the same has become due, sell such chattel or thing by public auction,
upon giving to the owner thereof, or posting to him at his last known place of
abode in South Australia fourteen days before such sale, a notice in writing,
by registered letter, stating the amount of the debt, a description of the
chattel or thing to be sold, the time and place of sale, and the name of the
proposed auctioneer.
