64—Sheriff's officer and sheriff's vehicle
(1) For the purposes
of the Rules and the definition of "sheriff's officer in the dictionary at the
end of the Rules, a person appointed as a sheriff's officer under the
Sheriff's Act 1978 or the Courts Administration Act 1993 is a
sheriff's officer.
(2) Despite anything
in the definition of "sheriff's vehicle" in the dictionary at the end of the
Rules, a sheriff's officer will only be taken to be driving a vehicle in the
course of his or her duties as a sheriff's officer for the purposes of that
definition and the Rules if a passenger in the vehicle is a prisoner, young
offender or other person in the custody of the officer.
