(1) The mine operator
of an underground mine must ensure that a person who is to go underground is
provided with an appropriate self-contained self-rescuer if there is a risk of
an irrespirable atmosphere in the underground mine (including during an
emergency).
Maximum penalty:
(a) in
the case of an individual—$6 000;
(b) in
the case of a body corporate—$30 000.
(2) The mine operator
must ensure that the person is trained in the use of, and is able to use, the
self-rescuer provided.
Maximum penalty:
(a) in
the case of an individual—$6 000;
(b) in
the case of a body corporate—$30 000.
