(a) a
water industry entity is unable for any reason to gain access to a meter or to
read a meter for the purpose of measuring water supplied to the person by the
entity; and
(b) a
code or rules made under the Essential Services Commission Act 2002
relating to the provision of retail services to customers does not apply to
that supply of water,
the entity may, in accordance with any requirements of the Commission,
estimate the quantity of water supplied through the meter and that quantity
will be taken to be the quantity of water supplied for the purpose of any
amount payable for the supply of the water.
