AQUACULTURE (MISCELLANEOUS) AMENDMENT ACT 2012 (NO 27 OF 2012) - SECT 48

48—Insertion of section 82B

Before section 83 insert:

82B—Death, bankruptcy etc of lessee or licensee

        (1)         If a person holding an aquaculture lease or an aquaculture licence dies, the personal representative of the deceased, or some other person approved by the Minister on application, is to be taken to hold the lease or licence in the place of the deceased as from the date of the death until the expiration of 6 months from that date, or until such later day as may be fixed by the Minister.

        (2)         If a person holding an aquaculture licence becomes bankrupt or insolvent, the official receiver may carry on aquaculture under the licence as if the official receiver held the licence in place of the person.

        (3)         If a body corporate holding an aquaculture licence is being wound up or is under administration, receivership or official management, a person vested by law with power to administer the affairs of the body corporate may carry on aquaculture under the licence as if the person held the licence in place of the body corporate.
