7—Amendment of section 22—Duties of employers and self-employed
persons
Section 22(2)—delete subsection (2) and substitute:
(2) An employer or
self-employed person must ensure, so far as is reasonably practicable, that
any other person (not being an employee employed or engaged by the employer or
the self-employed person) is safe from injury and risks to health—
(a)
while the other person is at a workplace that is under the management and
control of the employer or self-employed person; or
(b)
while the other person is in a situation where he or she could be adversely
affected through an act or omission occurring in connection with the work of
the employer or self-employed person.
Maximum penalty:
(a) for
a first offence—Division 2 fine;
(b) for
a subsequent offence—Division 1 fine.
