Section 40(2)—delete subsection (2) and substitute:
(2) Where a person is
known to a surveyor, or to a surveying services provider, to be a disqualified
person, and the surveyor or surveying services provider employs or engages
that person in connection with a survey without the prior approval of the
Court, the surveyor or surveying services provider is guilty of an offence.
Penalty: Division 5 fine
