STATUTES AMENDMENT (ELECTRICITY AND GAS) ACT 2017 (NO 21 OF 2017) - SECT 38

38—Insertion of section 91B

After section 91A insert:

91B—Offences

        (1)         The following persons are authorised to give expiation notices for an alleged offence against this Act (in addition to any person authorised under the Expiation of Offences Act 1996

):

            (a)         any authorised officer authorised in writing by the Technical Regulator;

            (b)         any electricity officer authorised in writing by the Technical Regulator.

        (2)         An authorisation under subsection (1)

may be given subject to such conditions or limitations as the Technical Regulator thinks fit.

        (3)         An apparently genuine document purporting to be under the hand of the Technical Regulator and to give an authorisation under subsection (1)

must be accepted, in the absence of proof to the contrary, as proof of the authorisation.
