STATUTES AMENDMENT (TERROR SUSPECT DETENTION) ACT 2017 (NO 69 OF 2017) - SECT 7

7—Amendment of section 5—Bail authorities

        (1)         Section 5(1)—delete "The following" and substitute:

Subject to subsection (3), the following

        (2)         Section 5—after subsection (2) insert:

        (3)         If the eligible person is a terror suspect—

            (a)         only a court may act as a bail authority in accordance with subsection (1) in relation to the eligible person; and

            (b)         a terrorism intelligence authority is entitled to be heard in relation to any application under this Act relating to the eligible person.
