16—Status of person making preventative detention order
(1) An
issuing authority who—
(a)
makes, extends or revokes a preventative detention order; or
(b)
makes or revokes a prohibited contact order in relation to a person’s
detention under a preventative detention order,
has, in the performance of his or her duties under this Act, the same
protection and immunity as a Judge of the Supreme Court.
(2) A function
of—
(a)
making or revoking a preventative detention order; or
(b)
extending, or further extending, the period for which a preventative detention
order is to be in force; or
(c)
making or revoking a prohibited contact order in relation to a person’s
detention under a preventative detention order,
that is conferred on a Judge is conferred on the Judge in a personal capacity
and not as a court or a member of a court.
