Administrative Arrangements (Interpretative Provisions) Proclamation 2016

under section 8 of the Administrative Arrangements Act 1994

1—Short title

This proclamation may be cited as the Administrative Arrangements (Interpretative Provisions) Proclamation 2016.

2—Commencement

This proclamation will come into operation on 1 November 2016.

3—Interpretative provisions

(1) A reference to the "Chief Executive" in the Adoption Act 1988

will have effect as if it were a reference to the Chief Executive of the Department for Child Protection.

(2) A reference to the "Department" in the Family and Community Services Act 1972

will have effect as if it were a reference to the Department for Child Protection.

(3) A reference to the "Department" in regulation 5 of the Children's Protection Regulations 2010

will have effect as if it were a reference to the Department for Child Protection.

(4) A reference to the "Chief Executive" in an order or document made or prepared for the purposes of Part 4 or 5 of the Children's Protection Act 1993

before the effective date and still in force on the effective date will have effect as if it were a reference to the Chief Executive of the Department for Child Protection.

(5) A reference to the "Department for Education and Child Development" in the instrument of delegation signed by the Commonwealth Minister for Immigration and Border Protection under the Immigration (Guardianship of Children) Act 1946 will have effect as if it were a reference to the Department for Child Protection.

(6) In this clause—

effective date means the date on which this proclamation comes into operation.
