Administrative Arrangements (References to Ministers) Proclamation 2004

under section 8 of the Administrative Arrangements Act 1994

1—Short title

This proclamation may be cited as the Administrative Arrangements (References to Ministers) Proclamation 2004.

2—Commencement

This proclamation comes into operation on the day on which it is made.

3—Interpretative provision

(1) A reference to the Minister for Social Justice in an Act or a statutory instrument under an Act will, if the Act was on the day immediately before the effective date, committed to the administration of that Minister, have effect as if it were a reference to the Minister to whom the administration of the Act is for the time being committed.

(2) A reference to the Minister for Social Justice in a statutory instrument or any other kind of instrument, or a contract, agreement or other document, made or entered into before the effective date (other than a reference to which subclause (1) is applicable) will have effect as if it were a reference to the Minister for Social Inclusion, the Minister for Families and Communities, the Minister for Ageing or the Minister for Disability according to the distribution of Ministerial responsibilities and functions between the relevant Ministers so that the reference will have effect as if it were a reference to the Minister to whom the relevant responsibilities or functions are currently assigned.

(3) A reference to the Minister for Local Government in an Act or a statutory instrument under an Act will, if the Act was on the day immediately before the effective date, committed to the administration of that Minister, have effect as if it were a reference to the Minister to whom the administration of the Act is for the time being committed.

(4) A reference to the Minister for Local Government in a statutory instrument or any other kind of instrument, or a contract, agreement or other document, made or entered into before the effective date (other than a reference to which subclause (3) is applicable) will have effect as if it were a reference to the Minister for State/Local Government Relations.

(5) In this clause—

effective date means the date on which this proclamation is made.
