Administrative Arrangements (References to Ministers) Proclamation 2018
under section 8 of the Administrative Arrangements Act 1994
1—Short title
This proclamation may be cited as the Administrative Arrangements (References to Ministers) Proclamation 2018.
2—Commencement
This proclamation comes into operation on the day on which it is made.
3—Interpretative provisions
(1) A reference to the Minister for Aboriginal Affairs and Reconciliation in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Premier.
(2) A reference to the Minister for Ageing in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Health and Wellbeing.
(3) A reference to the Minister for Agriculture, Food and Fisheries in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Primary Industries and Regional Development.
(4) A reference to the Minister for the Arts in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Premier.
(5) A reference to the Minister for Automotive Transformation in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Industry and Skills.
(6) A reference to the Minister for the City of Adelaide in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Transport, Infrastructure and Local Government.
(7) A reference to the Minister for Climate Change in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Environment and Water.
(8) A reference to the Minister for Communities and Social Inclusion in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Human Services.
(9) A reference to the Minister for Consumer and Business Services in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Attorney-General.
(10) A reference to the Minister for Correctional Services in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Police, Emergency Services and Correctional Services.
(11) A reference to the Minister for Defence and Space Industries in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Premier.
(12) A reference to the Minister for Disabilities in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Human Services.
(13) A reference to the Minister for Education and Child Development in an Act or a statutory instrument under an Act will, if the Act was, on the day immediately before the effective date, committed to the administration of that Minister, have effect as if it were a reference to the Minister to whom the administration of the Act is for the time being committed.
(14) A reference to the Minister for Education and Child Development in a statutory instrument or any other kind of instrument, or a contract, agreement or other document, made or entered into before the effective date (other than a reference to which subclause (13)
is applicable) will have effect as if it were a reference to the Minister for Education or the Minister for Child Protection according to the distribution of Ministerial responsibilities and functions between the relevant Ministers so that the reference will have effect as if it were a reference to the Minister to whom the relevant responsibilities or functions are currently assigned.
(15) A reference to the Minister for Emergency Services in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Police, Emergency Services and Correctional Services.
(16) A reference to the Minister for Employment in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Industry and Skills.
(17) A reference to the Minister for Finance in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Treasurer.
(18) A reference to the Minister for Forests in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Primary Industries and Regional Development.
(19) A reference to the Minister for Health in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Health and Wellbeing.
(20) A reference to the Minister for Health Industries in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Trade, Tourism and Investment.
(21) A reference to the Minister for Higher Education and Skills in an Act or a statutory instrument under an Act will, if the Act was, on the day immediately before the effective date, committed to the administration of that Minister, have effect as if it were a reference to the Minister to whom the administration of the Act is for the time being committed.
(22) A reference to the Minister for Higher Education and Skills in a statutory instrument or any other kind of instrument, or a contract, agreement or other document, made or entered into before the effective date (other than a reference to which subclause (21)
is applicable) will have effect as if it were a reference to the Minister for Education or the Minister for Industry and Skills according to the distribution of Ministerial responsibilities and functions between the relevant Ministers so that the reference will have effect as if it were a reference to the Minister to whom the relevant responsibilities or functions are currently assigned.
(23) A reference to the Minister for Housing and Urban Development in an Act or a statutory instrument under an Act will, if the Act was, on the day immediately before the effective date, committed to the administration of that Minister, have effect as if it were a reference to the Minister to whom the administration of the Act is for the time being committed.
(24) A reference to the Minister for Housing and Urban Development in a statutory instrument or any other kind of instrument, or a contract, agreement or other document, made or entered into before the effective date (other than a reference to which subclause (23)
is applicable) will have effect as if it were a reference to the Minister for Human Services or the Minister for Transport, Infrastructure and Local Government. according to the distribution of Ministerial responsibilities and functions between the relevant Ministers so that the reference will have effect as if it were a reference to the Minister to whom the relevant responsibilities or functions are currently assigned.
(25) A reference to the Minister for Industrial Relations in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Treasurer.
(26) A reference to the Minister for Investment and Trade in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Trade, Tourism and Investment.
(27) A reference to the Minister for Justice Reform in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Attorney-General.
(28) A reference to the Minister for Local Government in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Transport, Infrastructure and Local Government.
(29) A reference to the Minister for Manufacturing and Innovation in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Industry and Skills.
(30) A reference to the Minister for Mental Health and Substance Abuse in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Health and Wellbeing.
(31) A reference to the Minister for Multicultural Affairs in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Premier.
(32) A reference to the Minister for Police in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Police, Emergency Services and Correctional Services.
(33) A reference to the Minister for the Public Sector in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Treasurer.
(34) A reference to the Minister for Racing in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Recreation, Sport and Racing.
(35) A reference to the Minister for Recreation and Sport in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Recreation, Sport and Racing.
(36) A reference to the Minister for Regional Development in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Primary Industries and Regional Development.
(37) A reference to the Minister for Road Safety in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Police, Emergency Services and Correctional Services.
(38) A reference to the Minister for Science and Information Economy in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Industry and Skills.
(39) A reference to the Minister for Small Business in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Industry and Skills.
(40) A reference to the Minister for Social Housing in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Human Services.
(41) A reference to the Minister for State Development in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Industry and Skills.
(42) A reference to the Minister for the Status of Women in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Human Services.
(43) A reference to the Minister for Sustainability, Environment and Conservation in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Environment and Water.
(44) A reference to the Minister for Tourism in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Trade, Tourism and Investment.
(45) A reference to the Minister for Transport and Infrastructure in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Transport, Infrastructure and Local Government.
(46) A reference to the Minister for Veterans' Affairs in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Premier.
(47) A reference to the Minister for Volunteers in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Human Services.
(48) A reference to the Minister for Water and the River Murray in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Environment and Water.
(49) A reference to the Minister for Youth in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Human Services.
(50) In this clause—
effective date means the date on which this proclamation is made.
