Fire and Emergency Services (Bushfire Management Areas) Proclamation 2012

under section 72(1) of the Fire and Emergency Services Act 2005

1—Short title

This proclamation may be cited as the Fire and Emergency Services (Bushfire Management Areas) Proclamation 2012.

2—Commencement

This proclamation comes into operation on the day on which it is made.

3—Division of State into Bushfire Management Areas

(1) Pursuant to section 72(1) of the Fire and Emergency Services Act 2005, the State is divided into the following bushfire management areas:

(a) the Adelaide Mount Lofty Ranges bushfire management area;

(b) the Fleurieu bushfire management area;

(c) the Flinders Mid-North and Yorke bushfire management area;

(d) the Kangaroo Island bushfire management area;

(e) the Limestone Coast bushfire management area;

(f) the Lower Eyre Peninsula bushfire management area;

(g) the Murray Mallee bushfire management area;

(h) the Outback bushfire management area;

(i) the Upper Eyre Peninsula bushfire management area.

(2) The area of a bushfire management area referred to in subclause (1) is as set out in Schedule 1 in respect of the bushfire management area.

Schedule 1—Areas of bushfire management areas

1—Adelaide Mount Lofty Ranges bushfire management area

(1) Subject to subclause (2), the Adelaide Mount Lofty Ranges bushfire management area is comprised of the areas (within the meaning of the Local Government Act 1999) of the following councils:

(a) Adelaide Hills Council;

(b) The Barossa Council;

(c) City of Burnside;

(d) The Corporation of the City of Campbelltown;

(e) Town of Gawler;

(f) The Corporation of the City of Marion;

(g) City of Mitcham;

(h) The District Council of Mount Barker;

(i) City of Onkaparinga;

(j) City of Playford;

(k) City of Salisbury;

(l) City of Tea Tree Gully.

(2) The area of the Adelaide Mount Lofty Ranges bushfire management area does not include an area that falls within the Adelaide Metropolitan Fire District (other than an area that is within a designated urban bushfire risk area).

Note—

The Adelaide Metropolitan Fire District is established under section 4 of the Fire and Emergency Services Act 2005 (see Gazette 29.9.2011 p4097).

2—Fleurieu bushfire management area

The Fleurieu bushfire management area is comprised of the areas (within the meaning of the Local Government Act 1999) of the following councils:

(a) Alexandrina Council;

(b) City of Victor Harbor;

(c) The District Council of Yankalilla.

3—Flinders Mid-North and Yorke bushfire management area

The Flinders Mid-North and Yorke bushfire management area is comprised of the areas (within the meaning of the Local Government Act 1999) of the following councils:

(a) District Council of Yorke Peninsula;

(b) District Council of Barunga West;

(c) Clare and Gilbert Valleys Council;

(d) District Council of the Copper Coast;

(e) The Flinders Ranges Council;

(f) Regional Council of Goyder;

(g) Light Regional Council;

(h) The District Council of Mallala;

(i) The District Council of Mount Remarkable;

(j) Northern Areas Council;

(k) District Council of Orroroo/Carrieton;

(l) District Council of Peterborough;

(m) The Corporation of the City of Port Augusta;

(n) Port Pirie Regional Council;

(o) Wakefield Regional Council.

4—Kangaroo Island bushfire management area

The Kangaroo Island bushfire management area is comprised of the area (within the meaning of the Local Government Act 1999) of the Kangaroo Island Council.

5—Limestone Coast bushfire management area

The Limestone Coast bushfire management area is comprised of the areas (within the meaning of the Local Government Act 1999) of the following councils:

(a) District Council of Grant;

(b) Kingston District Council;

(c) City of Mount Gambier;

(d) Naracoorte Lucindale Council;

(e) The District Council of Robe;

(f) The District Council of Tatiara;

(g) Wattle Range Council.

6—Lower Eyre Peninsula bushfire management area

The Lower Eyre Peninsula bushfire management area is comprised of the areas (within the meaning of the Local Government Act 1999) of the following councils:

(a) District Council of Lower Eyre Peninsula;

(b) City of Port Lincoln;

(c) The District Council of Tumby Bay.

7—Murray Mallee bushfire management area

The Murray Mallee bushfire management area is comprised of—

(a) the areas (within the meaning of the Local Government Act 1999) of the following councils:

(i) The Berri Barmera Council;

(ii) The Coorong District Council;

(iii) The District Council of Karoonda East Murray;

(iv) District Council of Loxton Waikerie;

(v) Mid Murray Council;

(vi) Rural City of Murray Bridge;

(vii) Renmark Paringa Council;

(viii) Southern Mallee District Council; and

(b) Sections 72, 80, 83 and 84, Hundred of Katarapko.

Note—

The land description in paragraph (b) refers to the Gerard Community area.

8—Outback bushfire management area

The Outback bushfire management area is comprised of—

(a) the areas (within the meaning of the Local Government Act 1999) of the following councils:

(i) District Council of Coober Pedy;

(ii) Municipal Council of Roxby Downs; and

(b) any other area of the State that—

(i) is not otherwise within a bushfire management area; and

(ii) is not within a fire district.

9—Upper Eyre Peninsula bushfire management area

The Upper Eyre Peninsula bushfire management area is comprised of—

(a) the areas (within the meaning of the Local Government Act 1999) of the following councils:

(i) The District Council of Ceduna;

(ii) The District Council of Cleve;

(iii) The District Council of Elliston;

(iv) The District Council of Franklin Harbour;

(v) The District Council of Kimba;

(vi) Wudinna District Council;

(vii) The District Council of Streaky Bay;

(viii) The Corporation of the City of Whyalla; and

(b) Section 40 in the Hundred of Koongawa, County of Le Hunte.
