Gas Pipelines Access (South Australia) (Regulator under
Natural Gas Pipelines Access Act) Proclamation 2004
under section 50 of the Gas Pipelines Access (South Australia) Act 1997 and section 5 of the Natural Gas Pipelines Access Act 1995
1 Pursuant to section 50 of the Gas Pipelines Access (South Australia)
Act 1997, arbitration or legal proceedings under the repealed
Natural Gas Pipelines Access Act 1995 that have commenced but not been
completed when an access arrangement is approved in relation to a pipeline under
the Gas Pipelines Access (South Australia) Act 1997 may be continued
under the repealed Natural Gas Pipelines Access Act 1995 as if an access
arrangement had not been so approved.
2 For the purposes of the continuation of such proceedings, it is necessary
that a person exercise the functions of regulator under the repealed Natural
Gas Pipelines Access Act 1995.
3 This proclamation revokes an earlier assignment under section 5 of the
repealed Natural Gas Pipelines Access Act 1995 of the functions of
regulator to the Chief Executive of the Office of Energy Policy as that office
has been restructured and reassigns the functions of regulator to the Executive
Director, Minerals and Energy in the Department of Primary Industries and
Resources.
This proclamation may be cited as the Gas Pipelines Access (South
Australia) (Regulator under Natural Gas Pipelines Access Act) Proclamation
2004.
This proclamation comes into operation on the day on which it is
made.
3—Assignment of functions of
regulator
(1) The assignment of functions of the regulator under the Natural Gas
Pipelines Access Act 1995 made on 31 July 1997 (see Gazette 31.7.1997
p236) is revoked.
(2) The functions of the regulator under the Natural Gas Pipelines
Access Act 1995 are assigned to the person for the time being appointed to,
or assigned to act in, the position of Executive Director, Minerals and Energy
in the Department of Primary Industries and Resources.
