Mining (Variation of Private Mine) Proclamation 2016
under section 73N of the Mining Act 1971
1 The following area was declared to be a private mine by a proclamation made pursuant to the Mining Act 1971
on 3 May 1973 (Gazette 3.5.1973 p926):
That portion of section 1013, hundred of Yankalilla, county of Hindmarsh, and being the whole of the land comprised and described in certificate of title, register book, volume 3464, folio 190.
2 The Warden's Court has declared (on 19 January 2016 in Action No. 1773 of 2015) that proper grounds exist for varying the declaration referred to in clause 1 by excising the following land from the area of the private mine:
Certificates of Title Register Book Volume 6165 Folio 534, Volume 6165 Folio 535, Volume 6169 Folio 533, Volume 6169 Folio 758, Volume 6169 Folio 759, Volume 6169 Folio 761, Volume 6169 Folio 760 and Volume 6165 Folio 538 (formerly allotments 1001 and 1003 in Deposited Plan No. 89038).
1—Short title
This proclamation may be cited as the Mining (Variation of Private Mine) Proclamation 2016.
2—Commencement
This proclamation comes into operation on the day on which it is made.
3—Variation of private mine
The declaration referred to in clause 1 of the preamble is varied by excising from the area of the private mine the portions of the private mine described in clause 2 of the preamble.
