Mining (Variation of Private Mine) Proclamation 2017
under section 73N of the Mining Act 1971
1 The following area was declared to be a private mine by a proclamation made pursuant to the Mining Act 1971
on 3 May 1973 (Gazette 3.5.1973 p1926):
That portion of section 1013, hundred of Yankalilla, county of Hindmarsh, and being the whole of the land comprised and described in certificate of title, register book, volume 3464, folio 190.
2 The declaration referred to in clause 1 was varied by proclamations made pursuant to the Mining Act 1971
on 18 September 2008 (Gazette 18.9.2008 p4506) and 5 May 2016 (Gazette 5.5.2016 p1382) to excise certain land from the area of the mine.
3 The Warden's Court has declared (on 15 March 2017 in Action No. 57 of 2017) that proper grounds exist for varying the declaration referred to in clause 1 (as varied) by excising the following land from the area of the private mine:
Certificate of Title, Register Book, Volume 6000, Folio 43, being Allotment (Reserve) 145 Deposited Plan 75445.
1—Short title
This proclamation may be cited as the Mining (Variation of Private Mine) Proclamation 2017.
2—Commencement
This proclamation comes into operation on the day on which it is made.
3—Variation of private mine
The declaration referred to in clause 1 of the preamble (as varied) is varied by excising from the area of the private mine the land described in clause 3 of the preamble.
