Railways (Operation and Access) (Assignment of Functions
of Regulator) Proclamation 2004
under section 9 of the Railways (Operations and Access) Act 1997
This proclamation may be cited as the Railways (Operation and Access)
(Assignment of Functions of Regulator) Proclamation 2004.
This proclamation comes into operation on the day on which it is
made.
In this proclamation—
Act means the Railways (Operations and Access)
Act 1997;
Essential Services Commission means the commission of that
name established under the Essential Services Commission
Act 2002.
A previous assignment under section 9 of the Act of the functions of the
regulator under the Act is revoked.
5—Assignment of functions of
regulator
The functions of the regulator under the Act are assigned to the Essential
Services Commission.
