South Australian Health Commission (St Margaret's
Rehabilitation Hospital Incorporated)
Proclamation 2004
under section 27(6)(a) of the South Australian Health Commission Act 1976
1 The institution now known as St Margaret's Rehabilitation Hospital
Incorporated was founded pursuant to a Declaration of Trust dated 11 August 1874
under which certain land was declared to be held for a charitable institution
for the reception of convalescent patients.
2 The charitable institution was incorporated as an association in 1877 and
in 1990 a hospital was incorporated under the South Australian Health
Commission Act 1976 (and assigned the name "St. Margaret's Hospital
Incorporated") to take over the functions of the hospital being conducted by the
association for the purposes of the trust (see Gazette 7.6.1990
p1550).
3 By further proclamation under the South Australian Health Commission
Act 1976 the name of the incorporated hospital was altered to "St
Margaret's Rehabilitation Hospital Incorporated" (see Gazette 10.10.2002
p3774).
4 The governing body of St Margaret's Rehabilitation Hospital Incorporated
(St Margaret's) has now resolved to seek the exercise of the
powers conferred by section 27(6)(a) of the South Australian Health
Commission Act 1976 and has nominated the Central Northern Adelaide
Health Service Incorporated (the Service) as the body to take over
the whole of the undertaking of the hospital.
5 The resolution of the governing body referred to in clause 4 notes that
the Service will apply the assets vested in it by this proclamation for the
purposes of any trust under which St Margaret's currently holds those
assets.
This proclamation may be cited as the South Australian Health Commission
(St Margaret's Rehabilitation Hospital Incorporated)
Proclamation 2004.
This proclamation will come into operation on 1 July 2004.
3—Transfer of undertaking and
dissolution of hospital
(1) The whole of the undertaking of St Margaret's Rehabilitation
Hospital Incorporated (including all its assets and liabilities) are transferred
to the Central Northern Adelaide Health Service Incorporated.
(2) St Margaret's Rehabilitation Hospital Incorporated is
dissolved.
