Wilderness Protection (Nullarbor Wilderness Protection Area) Proclamation 2013

under sections 22(1) and 28(4) of the Wilderness Protection Act 1992

Preamble

1 The whole of the land described in Schedule 1 is a part of a reserve under the National Parks and Wildlife Act 1972 (part of the land is part of the Nullarbor National Park and the remainder of the land is part of the Nullarbor Regional Reserve).

2 It is intended that, by this proclamation, the land described in Schedule 1 be constituted as a wilderness protection area under the Wilderness Protection Act 1992.

3 On being so constituted, the land described in Schedule 1 will cease to be part of a reserve under the National Parks and Wildlife Act 1972 (see section 22(7) of the Wilderness Protection Act 1992).

4 It is also intended that the licences currently in force under the National Parks and Wildlife Act 1972 in respect of the land described in Schedule 1 that are set out in Schedule 2 continue in force under the Wilderness Protection Act 1992 after the commencement of this proclamation.

1—Short title

This proclamation may be cited as the Wilderness Protection (Nullarbor Wilderness Protection Area) Proclamation 2013.

2—Commencement

This proclamation comes into operation on the day on which it is made.

3—Constitution of Nullarbor Wilderness Protection Area

The land described in Schedule 1 is constituted as a wilderness protection area and is assigned the name Nullarbor Wilderness Protection Area.

4—Preservation of licences

The licences under section 35 of the National Parks and Wildlife Act 1972 in force in respect of the land described in Schedule 1 immediately before the commencement of this proclamation that are set out in Schedule 2 are preserved.

Made by the Governor

on the recommendation of the Minister for Sustainability, Environment and Conservation and having considered whether the licences referred to in clause 4 by their operation will cause, or contribute to, a reduction in the degree to which the land meets the wilderness criteria, and with the advice and consent of the Executive Council
on 6 June 2013
