This legislation has been repealed.
163—Cancellation if works not constructed or used
(1) The Minister may,
in accordance with a scheme prescribed by the regulations, cancel a water
resource works approval if works within the ambit of the approval are not,
over a period prescribed by the regulations—
(a)
constructed, or substantially completed; or
(b)
used, or used to any significant degree.
(2) The holder of a
water resource works approval may appeal to the ERD Court against a decision
under subsection (1)
.
(3) However, if the
approval relates to a water resource within the Murray-Darling Basin then no
right of appeal will arise under subsection (2)
if the regulations so provide.
