(1) The Minister may,
in accordance with a scheme prescribed by the regulations, cancel a site use
approval in prescribed circumstances.
(2) The holder of a
site use approval may appeal to the ERD Court against a decision under subsection (1)
.
(3) However, if the
approval relates to a water resource within the Murray-Darling Basin then no
right of appeal will arise under subsection (2)
if the regulations so provide.
