37—Certain persons not to be involved in the administration of a
retirement village
(1) A person to whom
this section applies may not be concerned in the administration or management
of a retirement village.
Maximum penalty: $35 000.
(2) This section
applies to—
(a) a
person who is an insolvent under administration within the meaning of the
Corporations Act 2001 of the Commonwealth; or
(b) a
person who—
(i)
has during the preceding 5 years been convicted of an
offence to the person or an offence involving fraud or dishonesty; or
(ii)
has served a sentence of imprisonment for an offence to
the person or an offence involving fraud or dishonesty, being a sentence that
ended during the preceding 5 years.
