If any person commits any irregularity, trespass, or other wrongful proceeding
in execution of this Act, or omits to do anything which in pursuance of this
Act, or by virtue of any power or authority hereby given, he ought to do, and
makes tender to the person injured, his solicitor or agent, of such amends as,
in the opinion of the court at the trial were sufficient, such last-mentioned
person shall not recover in any such action.
