CLAUSE NOTES Fire Service (Extension of Regulations) Bill 2017 PART 1 – PRELIMINARY Clause 1: Short title Specifies the name of the proposed Act. Clause 2: Commencement Specifies that the Act commences on the day it receives the Royal Assent. Clause 3: Interpretation This clause provides that any reference in the Act to Fire Service (Finance) Regulations 2006, means a reference to those regulations as they were in force, immediately prior to 15 May 2016. Clause 4: Repeal of the Fire Service (Finance) Regulations 2006 taken to have been postponed Specifies that despite section 11(2) of the Subordinate Legislation Act 1992, (which automatically repeals subordinate legislation on its tenth anniversary), the Fire Service (Finance) Regulations 2006 are not deemed to have expired on that date (15 May 2016). Instead they are deemed to have expired on midnight 18 April 2017, the date the replacement regulations took effect. For the avoidance of doubt, the clause adds that the 2006 regulations are deemed to be in full effect from 16 May 2006 until midnight 18 April 2017. Furthermore, nothing in subsections 11(1) or 11(2) of the Subordinate Legislation Act 1992 is taken to limit regulation 6 of those regulations (prescribed collection of fees) for the financial years starting 1 July 2015 and 1 July 2016. Clause 5: Administration of Act This clause provides that the administration of this Act is assigned to the Minister for Police, Fire and Emergency Management and in turn, that Department. Page 1 of 1
