FACT SHEET Historic Cultural Heritage Amendment (Validation) Bill 2014 Amendments to the Historic Cultural Heritage Act 1995 came into effect on 1 March 2014. The amendments introduced greater alignment and integration with the State's planning system, making it easier for property owners and developers to seek approval for works to places entered on the Tasmanian Heritage Register. Unfortunately, those amendments omitted to make clear the provisions to be applied to works applications received by the Tasmanian Heritage Council before 1 March 2014, but not determined until after that date. This Bill will validate 21 decisions made by the Heritage Council to ensure no legal doubt remains as to the validity of those decisions. The Bill also clarifies how to proceed with one application which remains on hold at the request of the developer. The State Government was informed of the matter in August 2014 and has responded quickly to remove any future legal doubt for affected property owners, developers and the Tasmanian Heritage Council.
