VETERINARY SURGEONS ACT 1987 - SECT 40
Offences by veterinary services entities
(1) Where an offence against this Act is committed by a veterinary
services company, every person concerned in the management of the company
shall be deemed also to have committed the offence and may be convicted of the
offence, unless he proves that the act or omission constituting the offence
took place without his knowledge or consent.
(2) A person referred to in subsection (1) may be convicted of an
offence under that subsection whether or not the veterinary services company
is charged with or convicted of the offence.
(3) Where an offence against this Act is committed by a person (in this
section referred to as " the principal offender " ) who is a partner in a
veterinary services partnership, every other partner in the partnership is
deemed also to have committed the offence and may be convicted of the offence,
unless the other partner proves that the act or omission constituting the
offence took place without the other partner's knowledge or consent.
(4) A partner referred to in subsection (3) may be convicted of an
offence under that subsection whether or not the principal offender who
committed the offence referred to in that subsection is charged with or
convicted of the offence.
