MAGISTRATES COURT (CIVIL DIVISION) RULES 1998 - REG 93

Notice of payment into Court
(1)  On making a payment into Court under rule 92(1) , the party paying is to file and serve on the other party notice in writing of the payment.
(2)  The notice of payment is to specify –
(a) the sum offered referable to the sum of money claimed in the proceeding; and
(b) the sum offered for costs.
(3)  If the notice does not comply with subrule (2)  –
(a) the payment is taken to refer only to the sum of money claimed in the proceeding; and
(b) the party accepting the payment is entitled to costs of the claim until the date of payment into Court.
