SUPREME COURT RULES 2000 - REG 362

Dismissal of application
(1)  A judge may dismiss an application under rule 356 or 360 with costs if –
(a) the case is not within this Division; or
(b) the plaintiff or defendant knew that the party against whom judgment was sought relied on a contention that would entitle that party to unconditional leave to defend.
(2)  The judge may require the costs to be paid immediately.
