(1) The Court or a judge may authorise a sale of land to be carried out by proceedings out of Court.(2) Any money produced by a sale out of Court are to be as the Court or judge orders.(a) paid into Court or to trustees; or(b) otherwise dealt with (3) The Court or a judge is not to make an order under subrule (1) unless each person interested in the land to be sold is before the Court or is bound by the order.(4) An order under subrule (1) is to be prefaced by (a) a declaration that the Court or a judge is satisfied of the matters referred to in subrule (3) ; and(b) a statement of the evidence on which the declaration is made.
