(1) If, in any proceeding, a party improperly or unnecessarily does any act or makes any omission, the Court or a judge may direct that (a) the party not be allowed costs in respect of that act or omission; and(b) any costs incurred by another party as a result be paid by the first-mentioned party.(2) For the purposes of subrule (1) but without limiting its generality, the Court or judge is to take into account the following matters:(a) the omission to do anything the doing of which would have been calculated to save costs;(b) the doing of anything calculated to cause, or in a manner or at a time calculated to cause, unnecessary costs;(c) any unnecessary delay in the proceeding.
